This distance sales agreement is valid and deemed signed for all users who make a purchase from the moment they register on our site, under the following terms and conditions between the parties listed below. By accepting this agreement, the Buyer acknowledges in advance that they are obliged to pay the specified additional fees, such as the service fee and taxes, and have been informed about this.

Definitions

The terms below shall have the meanings assigned to them in the implementation and interpretation of this agreement:

Seller: Refers to the company that offers goods to the consumer within the scope of its commercial or professional activities or acts on behalf of or in the name of a company providing goods.
Buyer: Refers to the individual or legal entity that has approved this Agreement to obtain the services specified in the Agreement from the Company.
Customer: Refers to the individual or legal entity that has approved this Agreement to obtain the services specified in the Agreement from the Company.
Service: Refers to any consumer transaction provided by the Seller to the Buyer, excluding the provision of physical goods, in exchange for a fee or promised payment.
Site: Refers to the website belonging to the Seller.
Parties: Refers to the Seller and the Buyer.
Agreement: Refers to this agreement concluded between the Seller and the Buyer.
Subject of the Agreement

This Agreement regulates the rights and obligations of the parties regarding the sale and delivery of the service specified in the payment page, ordered by the BUYER via the Seller’s website, under the provisions of the Law on the Protection of the Consumer No. 6502 and the Regulation on Distance Contracts. It also determines the conditions for the use of the services offered on the ‘Site,’ as well as the rights and obligations of the parties.

The listed and announced prices are sales prices. The announced prices and commitments remain valid until updated and changed. The prices announced for a limited time remain valid until the specified period expires.

Scope of the Agreement

All services sold through our website, referred to as An Idea Agency and AN IDEA SOSYAL MEDYA AJANSI, are listed in the “Main Menu” (Header) section of our website. The definitions, details, and scope of these services are clearly stated on their respective pages and may be updated or changed without notifying the Customer.

By purchasing any of these services, you are deemed to have accepted the Privacy Policy, Distance Sales Agreement, Information Disclosure Statement, Prohibited Services Policy, and Cookie Policy.

Scope of Services Provided

The scope and details of all services sold online through the An Idea Agency website are specified in the “Packages and Prices” section on the respective page of each service.

The scope of services provided online covers the features listed in the package purchased by the Customer.

The prices of all services and products published on the An Idea Agency website are subject to change and updates.

An Idea Agency does not finance services obtained from third parties or institutions that the customer may need as part of the purchased service package. If the Customer requires a service from a third party, the Customer must pay for this service separately.

An Idea Agency undertakes to provide technical support via email, phone, and Online Meetings for all services purchased by the Customer. The Customer can request monthly meetings online.

Payment Terms, Fees, and Billing

The Customer can benefit from the services explicitly stated on the An Idea Agency website by paying the fees through the payment methods and conditions determined by An Idea Agency.

The Customer may upgrade or downgrade their subscription package based on their preferences (“New Package”). Package upgrades are implemented once the payment is made by the User.

The payment for services charged on a monthly subscription model is collected upfront on the purchase date using the Customer’s Credit Card or Bank Card, and the service begins.

Every 30 (thirty) days thereafter, payments are automatically debited from the Customer’s Bank or Credit Card through Iyzico. If you cancel your subscription, you will not pay a withdrawal fee, and you will not be charged again. For one-time service fees, a one-time deduction is made from your Credit or Bank Card.

If the Agreement is terminated, including for subscription reasons, full payment will be charged for the period used, and unused periods will not be refunded.

The Customer’s account is restricted at the end of the subscription package period by An Idea Agency. The Customer can continue to access their account by purchasing a new subscription package.

An Idea Agency issues online invoices for every successful payment made by the Buyer. The Customer receives their invoice via the e-invoice system after successful payment. For customers not using e-invoices, the invoice will be delivered via email or other channels.

An Idea Agency does not store your personal bank information or payment details on its servers. In case of any issues, the payment infrastructure provider is fully authorized.

Limitations of Liability

To the maximum extent permitted by law, you acknowledge and agree that you are responsible for all risks arising from the payment methods. An Idea Agency will not be responsible for any incidental, special, consequential, or indirect damages resulting from the use of the payment methods.

Warranty Terms

An Idea Agency provides the services it commits to in digital marketing and web-based software and technology services after the Customer purchases the service.

An Idea Agency reserves the right to suspend or terminate the service without prior notice if any illegal activity is detected on the Customer’s website.

An Idea Agency does not review, endorse, or take responsibility for any content provided by the Customer.

Service Cancellation and Refund Conditions

As a rule, all service sales are final. You do not have a right of withdrawal or refund for the online services you have purchased or subscribed to.

Governing Law and Dispute Resolution

The entire terms and conditions of this Agreement are subject to Turkish Law. In case of any disputes, the courts and enforcement offices in Ankara will have jurisdiction.

Force Majeure

In all cases considered force majeure by law, the Seller is not liable for any delay or non-performance.

Intellectual Property Rights

All elements of this site, including but not limited to the design, text, and code, belong to the Seller. Buyers may not resell, share, distribute, or reproduce any content without the Seller’s permission.
